1. Service Description

EnGenAI is an AI-powered software development platform that provides teams of AI agents to assist with software engineering tasks. The service is currently in beta and subject to change.

2. AI-Generated Content Disclaimer

All code and content generated by EnGenAI's AI agents is produced by third-party large language models. EnGenAI does not guarantee the accuracy, completeness, security, or fitness for any particular purpose of AI-generated output. You are solely responsible for reviewing, testing, and validating all AI-generated code before deploying to any environment.

3. Limitation of Liability

EnGenAI shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: (a) the use or inability to use the service; (b) any errors, bugs, or security vulnerabilities in AI-generated code; (c) any loss of data, revenue, or business opportunities; (d) any actions taken based on AI-generated recommendations.

4. Payment Terms

All payments are pre-paid. Service access is suspended when credit balance reaches zero. Consumed credits are non-refundable. Subscription fees are billed in advance. All prices are in USD. Available plans: Starter, Pro, and Enterprise (custom pricing — contact sales). Annual billing available. Auto top-up may be enabled with a maximum of 3 automatic charges per day. Pro and Enterprise customers may connect their own API keys (BYO) for reduced LLM costs. All billing is processed through Stripe.

5. Intellectual Property

You retain full intellectual property rights to all code and content generated using the platform. Your code and data are not used to train AI models. EnGenAI retains rights to the platform software, AI agent configurations, and proprietary orchestration technology.

6. Acceptable Use

You agree not to use the service to: generate malicious code or malware; attempt to circumvent platform safety controls; violate any applicable laws; infringe on the intellectual property rights of others; or engage in activities that could harm EnGenAI's infrastructure or other users.

7. Termination

Either party may terminate this agreement at any time. Upon termination, you retain access to your generated code and data for 30 days. EnGenAI reserves the right to suspend or terminate accounts that violate these terms.
